Welcome to hey! pookee. This website (the "Site") is owned and operated by hey! pookee ("we", "us" or "our"). By visiting the Site, creating an account or buying from us, you agree to these Terms of Service. Please read them carefully. If you do not agree, please do not use the Site.

We may update these terms, the Site and our services at any time. The latest version will always be on this page. We may refuse or remove access to the Site for anyone who breaks these terms. If you are under 18, please use the Site only with the involvement of a parent or guardian.

1. Content you share with us

You are responsible for anything you post, send or upload to the Site, such as reviews, photos, videos, comments or messages ("Content"). By sharing Content with us, you allow hey! pookee to use, edit, copy and display it, including for marketing and promotion, in any media, in line with our Privacy Policy. You will not be paid for this use. You confirm that you own or have the right to share this Content and that it does not break anyone else's rights.

2. How to use the Site

When using the Site, you agree that you will not:

• post or share anything that is offensive, obscene, hateful, abusive, threatening, defamatory or illegal;
• harass anyone, or share another person's personal details, photos or videos without their clear permission (and never content of minors);
• send spam, chain messages or unwanted promotions to other users;
• share copyrighted material, trademarks or other people's property without written permission from the owner;
• upload viruses or harmful code, try to hack or overload the Site (including DoS/DDoS attacks), or access areas or accounts you are not allowed to;
• run contests, sales, gambling or other commercial activities on the Site without our written permission;
• give false or misleading information.

We may review, edit, refuse or delete any Content that we believe breaks these terms. You remain fully responsible for what you post. Content posted by users does not represent the views of hey! pookee. We may share information with authorities when required by law or to help investigate unlawful activity.

The Site may link to other websites, including partners or affiliates. These are for your convenience only. We do not control or endorse them and are not responsible for their content, products, services or privacy practices. You may link to our Site as long as the link does not suggest that we sponsor or endorse you. You may not use our logo, trademarks or content without our written permission.

4. Your account

You are responsible for keeping your account details and password safe and for all activity under your account. Our products are meant for adults (18+). Products suitable for younger users may only be purchased by an adult.

Your use of the Site is also governed by our Privacy Policy.

6. Your declaration when ordering

• You have given correct and complete details needed to deliver your order.
• The products are for your personal use (or the person you are sending them to) and will not be resold.

7. Products and descriptions

We do our best to describe and show our products accurately. However, colours, packaging and descriptions may vary slightly, and we cannot promise that every detail on the Site is always complete, current or error-free. If a product you receive is not as described, please see our Refund & Cancellation Policy. Our products are cosmetic products. Nothing on the Site is medical advice. Please read the ingredient list and do a patch test before use.

8. Orders, pricing and cancellation by us

All orders are subject to availability and confirmation. We may cancel any order, for example if a product is out of stock, if there is a pricing or technical error, or if the order does not meet our policies. If we cancel an order, we will let you know as soon as possible and refund any amount paid within a reasonable time.

9. Payments

You must enter a valid phone number when placing an order. You agree that we may contact you by call, SMS, WhatsApp or email about your order, shipping and delivery. We are not responsible for any loss caused if a payment is declined or fails, for example because of lack of authorisation, bank limits or issues with your bank or payment provider.

10. Delivery and risk

Once your order is handed over to our courier partner, the risk of loss passes to you. Please see our Shipping Policy for delivery details.

11. Sale in India only

Unless we say otherwise, products on the Site are sold only for delivery within India. If you access the Site from outside India, you do so on your own and are responsible for following your local laws.

12. Intellectual property

All material on the Site, including the hey! pookee name, logo, mascot, product names, packaging designs, images, videos and text, belongs to hey! pookee or our licensors and is protected by copyright, trademark and other laws. You may view it for personal, non-commercial use only. You may not copy, reproduce, republish, modify or distribute it without our written permission.

13. Disclaimer and limitation of liability

The Site and all products and services are provided "as is" and "as available". We do not promise that the Site will always be available, uninterrupted, or free of errors or viruses. To the extent allowed by law, hey! pookee is not liable for any indirect or consequential loss arising from your use of the Site. If we cannot deliver a product, we will refund or credit the amount you paid for it. Some laws do not allow certain limitations, so some of these may not apply to you.

These terms are governed by the laws of India. Any disputes will be subject to the jurisdiction of the competent courts in India.
